By accessing or using OptiVibeX, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the platform. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

OptiVibeX grants you a limited, non-exclusive, non-transferable licence to access and use the platform for your personal or organisational fitness tracking purposes. You agree not to:

• Use the service for any unlawful purpose or in violation of these terms
• Attempt to gain unauthorised access to any part of the platform
• Interfere with or disrupt the integrity or performance of the service
• Reverse engineer, decompile, or disassemble any part of the platform
• Use automated means to scrape, crawl, or extract data from the service

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account
• Promptly notify us of any unauthorised use of your account
• Ensure your password is kept secure and not shared with others
• Be responsible for all content you upload or submit through the platform

You retain ownership of all fitness data, session records, and content you submit to OptiVibeX. By using the platform, you grant us a limited licence to store, process, and display your data solely to provide the service. We do not claim ownership of your data. If you use OptiVibeX as a coach or administrator of an organisation, you agree to use athlete data only for legitimate coaching and performance purposes. You are responsible for obtaining any required consent from athletes under your management and for complying with applicable data protection laws.

All content, features, and functionality of the OptiVibeX platform — including but not limited to software, design, text, graphics, and logos — are the exclusive property of OptiVibeX and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

OptiVibeX is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. Fitness data and insights provided by the platform are for informational purposes only and do not constitute medical advice.

To the maximum extent permitted by law, OptiVibeX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

We may suspend or terminate your access to OptiVibeX at any time, with or without cause, with or without notice. Upon termination, your right to use the service will immediately cease. You may also delete your account at any time through your profile settings. Provisions of these terms that by their nature should survive termination will survive.

These Terms of Service are governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
